In the news today a judge upheld a lawsuit by Muslim detainees who allege they were beaten and starved in the post 9-11 roundup. They argue that the government violated their right to appeal their solitary confinement in a special unit of the Metropolitan Detention Center in Brooklyn. John Ashcroft counterargued that the threat of foreign terrorism exempts the government from following rules made in peacetime. His argument was rejected as well it should be. America doesn’t stop being America because 3,000 people die. We are supposed to be the good guys and that means presumption of innocence, equal protection under the law, and due process. Anybody who doesn’t like that can go back in time and join the Third Reich.

There are those who think that all the good guy and freedom talk is all talk and we’re really only out for our own interests. I will answer the second part first, there is nothing wrong with pushing for our own interests but if we are to remain America we must do so within the constraints of individual rights and constitutional law. And we are doing so. Witness the convictions of those who were involved in that un-American bullshit at Abu Ghraib. What they did was illegal, wrong, stupid and cowardly. Everyone who was involved should be prosecuted and sentenced for their crimes. That is to include any US intelligence people who may have been present (as some of the accused have alleged.)

This nation as I know it has always been a great place. Let it not change to something different just because some peoples emotions get out of hand. The fact that these trials are going forth means that there are others who believe in that justice is a part of the American way just as I do. Rock on.

I must go, I’m off to Detroit. But in summation let the court cases go forward and let those who are guilty get convicted, foreigners and Americans alike. Let them be judged on the their actions, not on the language they speak or where they were born. USA USA!!! Not the Evil Empire kind but the real one. The kind with rights and justice and shit. That will be all. Peace

    The constitution does not apply only to citizens. That’s what makes the US so great, we treat people like people no matter where they come from.

    Note that the judge ruled that not letting them appeal the decision to put them in adsec was the violation, not putting them in adsec in the first place. There’s lots of reasons to put someone in segreggation, not the least of which is that every redneck yahoo in general population was mastrubating furiously at night at the idea of being able to beat some Arab accused of terrorism to death with a wet towel.

    They get to appeal the decision to put them in segregation. That is when the warden gets to tell the court, “your Honor, I have 50 snaggletoothed hillbillys with four first names each waiting to get a piece of these two” and have the judge say, “you dumbasses want to go into that? OVERRULED!”

    Yeah, I got that. I just intensely dislike the argument that the threat of foreign terrorism exempts the government from following the normal rules. You let them get away with that and pretty soon they’ll chuck the Emancipation Proclamation until the war on terror is over. Then all hell breaks loose but Ashcroft doesn’t care cuz he’s neck deep in pancakes and cream of wheat.
